CONDITIONS OF SALE
Agreement for sale at a distance between Audiovisivamente Via Elettra 104, 65126 Pescara and the customer:

1. RESPONSIBILITY
Audiovisivamente declines responsibility for disservice due to acts of God such as accidents, explosions, fires, earthquakes, floods or other similar events including strikes and/or lockouts, that might make it impossible, totally or in part, to carry out the sale agreement in the time agreed upon. Audiovisivamente will not be responsible to anyone due to damage, loss and costs suffered as a result of the failed execution of the sale agreement due to the causes cited above, or as a result of damage, loss or costs suffered as a result of the use or impossibility of the use of the products purchased from Audiovisivamente, since the customer has the right to a refund of the agreed price, excluding any shipment costs involved.
At the same time, Audiovisivamente is not responsible for any fraudulent or illicit use that might be made by third parties, by credit card, cheques and other means of payment, at the time of payment of the products purchased. Audiovisivamente cannot know the number of the credit card of the purchaser at any moment during the purchase procedure; at the same time Audiovisivamente is not able to check the correct or licit source of the certificate of credit consigned by the customer when receiving the merchandise.

2. OBLIGATIONS OF THE PURCHASER - ORDER CONFIRMATION
Once the purchase procedure is concluded on line or by fax, the customer is responsible for printing and/or preserving the present general conditions which, however, he has already seen and accepted as an obligatory part of the purchase, and also the printing of the specifications of the product that is the object of purchase, in order to totally satisfy the conditions of articles 3 and 4 of Decree 185/99.
The web page indicating the general contract conditions must be printed, signed and sent by the customer to our fax number 085 9433860; alternatively, the order can be confirmed by sending an email to our email address, using the automatic email reply on our computer system/acceptance-orders.
Whenever a customer desires to be contacted directly by our sales department in order to facilitate the confirmation of an order, he can do this by sending an email with which, at the same time, he authorizes us to contact him at the phone number and/or email address given.
However, it is understood that, once confirmed, orders will only be dealt with after receiving payment (with the exception of cash on delivery).
It is strictly prohibited for the purchaser to provide data that is false and/or invented and/or imaginary in the registration procedure necessary to activate the procedure for the execution of the present sales agreement and any related further communications; the personal data and email address must be exclusively his actual personal data and not that of a third party.
For some types of products, when the order cannot be cancelled, even with cash on delivery, a down payment of 20% will be requested at the moment of the telephone/email confirmation of the order.

3. AUTHORIZATIONS
If a customer chooses to pay with a credit card by compiling the appropriate fields on our website, he thereby authorizes Audiovisivamente to use his credit card and to debit to his current bank account the total amount shown as the cost of the purchase made in favour of the above-mentioned company. The entire procedure is made through a protected connection directly linked to the bank that is the proprietor and manager of the online payment service, to which Audiovisivamente does not have access.
If the customer, having paid with a credit card, takes advantage of the right to a refund, the amount reimbursed will be credited to the same credit card.

4. CONTRACT CANCELLATION AND THE EXPLICIT CANCELLATION CLAUSE
The obligations assumed by the customer in Article 2 cited above (obligations of the purchaser) as well as the guarantee of successful conclusion of payment by the customer, are essential requirements, in that by express agreement, a breach of contract regarding even one of the mentioned obligations will cause the cancellation of the right of the contract according to Art. 1456 of the Civil Code without the need for judicial decision, except for the right of Audiovisivamente to go to court for damage compensation.

5. JURISDICTION AND LAW COURTS
Any controversy related to the application, execution, interpretation or violation of the online sale agreement obtained through the website www.Audiovisivamente.it is subject to Italian jurisdiction; the present general conditions, whenever not expressly stated here, refer to the provisions of Decree 50/92 and Decree 185/99.
Any controversy between the parties regarding the present contract will be exclusively the competence of the Pescara law courts.

6. GUARANTEE AND TYPE OF ASSISTANCE
The guarantee for a product is established by the manufacturer, who determines its duration (minimum one year) and conditions. Generally this service is supplied by the manufacturer of the goods sold and, where the practice of the latter requests it, Audiovisivamente will collaborate in handling the return under the guarantee.
Audiovisivamente is directly responsible for the guarantee of replacement lamps:
a) 30 days for original lamps;
b) 60 days for compatible lamps.
The 30 days for original lamps and the 60 days for replacement lamps begin on the date of consignment indicated on the waybill or other delivery documentation.
To take advantage of the guarantee, the goods must be returned in the original packing, including all its parts (even non-functioning ones), as when purchased, except for used materials originally supplied for demonstration purposes. In the case of authorization for return, the shipment of the defective goods is at the expense of the customer, while the restitution of the repaired or substituted goods will be paid by Audiovisivamente. If the goods returned under the guarantee are functioning perfectly, Audiovisivamente will return them at the expense of the customer. If the repair of the product does not fall under the guarantee, Audiovisivamente will inform the customer of the estimated cost. If the customer forgoes the repair, he will be debited with 25 euros requested by the service centre for examining the product. In any case, the reference norms and method of application of the guarantee are those provided and indicated by the manufacturer or distributor in the certificate attached to the product, if different from what is stated here.
The guarantee is not valid if the apparatus has been mishandled by non-authorized personnel, if the damage is due to carelessness or improper use by the purchaser, fraud, transport, shock, fall, humidity, discharge of battery liquid, the use of consumables not in conformity with the specifications of the manufacturer of the apparatus, or other causes not dependent on defects of fabrication or manufacture.
In any case, Audiovisivamente cannot be subjected to charges or damages deriving from any interruption of the functioning of the apparatus under guarantee.
Defective apparatus must be shipped, after authorization by Audiovisivamente, with the attached certificate of guarantee, at the customer's expense, to the following address: Audiovisivamente - Via Elettra 104, 65126 Pescara

Alternatively (or where provided), Audiovisivamente can inform the customer of the service centre where the defective product can be sent for repair under the guarantee.
The time required for repair at official service centres of most of the manufacturers is about 30 days.
In no instance can Audiovisivamente be subject to costs or damages deriving from any delay in repairs by third parties.

7. CHOICE TO EXERCISE THE RIGHT OF RETURN ACCORDING TO DECREE 185/99
Excluded from the decree are persons who cannot be classified as consumers, or who act for reasons related to any professional activity, that is, those who make an order indicating a VAT Number for the bill.
The customer has the right of return, without any penalty and without indicating the reason, within and not exceeding 10 working days from consignment (as shown by the consignment date indicated on the carrier's waybill).
The right of return is exercised within the provided period by sending a registered letter with return receipt requested and all the goods purchased to the following address: Audiovisivamente - Via Elettra 104, 65126 Pescara.
The communication can also be sent by fax, on the condition that it is confirmed by a registered letter with return receipt, within 48 hours.
Where the right of return is applicable, the customer must return at his expense all the articles indicated in the bill as they were received and therefore absolutely new, not used, and complete in all their parts and in the original packaging (bags and boxes). OPENING THE SEALED COMPUTER SOFTWARE MAKES THE RIGHT OF RETURN INAPPLICABLE in accordance with article 5, paragraph 3 of Decree 185/99. For more information regarding the software and the relative license, the manufacturer should be contacted.
Lack of observance of these principles makes the right of return inapplicable.
To return the goods, we advise our customers to use the insured Posta Celere service which is faster, safer and more economic, or one of the many couriers. We ask our customers to collaborate with us by following our procedure for returning goods and shipping goods for which the right of return is not applicable.
When the right of return is applicable, once the goods are received, Audiovisivamente will reimburse the entire amount paid by the customer, excluding shipment costs, within thirty days of receiving the communication, in the following manner: a goods exchange, a bank credit or cancellation of the payment made by credit card.
Please note: where the right of return is not applicable, the customer must pay the cost of collecting the goods at our office.

8. WITHDRAWAL BY SUPPLIER
If it is impossible to fulfil the order requested because of even temporary unavailability of the product ordered, Audiovisivamente can withdraw from the sale agreement within 30 days of the order date by sending the customer a simple justifying communication, according to article 6, paragraph 2 of Decree 185/99. In that case the customer is entitled only to restitution of any amount paid.

9. CONTRACTUAL CONDITIONS
Once the product ordered is ready for delivery, it can remain in our storehouse for a maximum of three days during which time other products can be added to the order.
After three days and on notification, Audiovisivamente will dispatch the goods, dealing with the order even partially with shipment cost paid by the retailer. Products in arrival or not available at that moment will be shipped later always with shipment costs paid by the consignee.
The retailer can request cancellation of an order via e-mail or fax.
In the case where, in order to deal with an order, the goods were expressly ordered by Audiovisivamente from the supplier and the latter does not accept cancellation of the order, the retailer must confirm the purchase, otherwise a penalty of 5% of the value of the products related to the order will be applied.

HANDLING PERSONAL DATA AND INFORMATION
Data supplied to us, in accordance with article 10 of Decree 675/96 regarding "protection of persons and other subjects in regard to treatment of personal data", will be treated, in the normal activity of our company, for:
1) purposes closely connected and instrumental in the management of relations with the compiler (internal statistics, satisfaction feedback, preliminary acquisition of information directed at the conclusion of a contract or the supplying of a service, etc.);
2) purposes connected with obligations under current legislation;
3) purposes pertaining to the activity of this company;
4) sending commercial communications.

Except for the right of the user to exercise the rights indicated in article 13 of Law 675/97.
For this purpose, the interested party can use the email address of the company requesting the data. The person responsible for the treatment of personal data effected by Audiovisivamente - Via Elettra 104, 65126 Pescara, is the pro-tempore Administrator of the same who is resident at the registered office of the same, and accessible at the following email address: info@Audiovisivamente.it.
Data is treated by suitable instruments to guarantee security and privacy in accordance with Decree No. 318/99 with access controlled and limited to authorized persons. The data will be preserved on computer drives at the Audiovisivamente office, Via Elettra 104, 65126 Pescara, for the time prescribed by law.

Damaged or mishandled packages
Every package is wrapped by Audiovisivamente with adhesive tape with the Audiovisivamente logo.
If a package is not intact, or if it is damaged or has evident signs of mishandling (open package or a closed one with adhesive tape different from the original one with the Audiovisivamente logo) you must inform the courier who delivers the package and absolutely sign the waybill adding the words "CON RISERVA" (WITH RESERVATIONS). This protects you if you find any type of anomaly on opening the package. Only in the latter case is it necessary to indicate the fact by fax to the local office of the courier and, for our information, to Audiovisivamente at 085 9433860.

TO RETURN GOODS
In order to allow Audiovisivamente personnel to correctly manage the return, the customer should read paragraphs 6 and 7 of the general sales conditions and request the authorization number when returning the product by filling in the appropriate return request form online after logging in.
